IRD makes its own rules.

In an attempt to reduce the escalating child support arrears figure the IRD has resorted to making up its own rules. Don’t be surprised if you find the IRD behaving in an illegal manner. Either someone in Government has said forget the rules, just get the money, or there is a vigilantly group operating within the IRD out to get those so called errant fathers who refuse to pay their child tax.

Either way this reflects badly on revenue minister Peter Dunne. This is an issue currently before a select committee which leaves no excuse for such tyrannical behaviour.

    What are they doing that is illegal and who could this ‘vigilanty group’
    be.

    This relates specifically to child support. Mr Dunne simply refuses to answer questions as he normally does. That makes him aware and as guilty as those involved. You may have seen my earlier post regarding IRD documentation. Many other men may find themselves being railroaded through illegal processes that they simply cannot afford to defend. Hopefully posts like this will let other men know they are not isolated targets who cannot fight back.

    Hi fellow non custodial parents living in poverty whole some of their partners have remarried to affluent people.As you may know;there is a group of feminazi clerks in hamilton who will flippantly put a theft order on your wages if you become behind in your payments.I phoned up the IRD and played the totally distraught father;which I was and they removed it.I am going to try an administrative review with a note from a shrink mentioning my suicidal ideation and actions due to my unliveable child support situation.Does anyone have any tips regarding the theft review process?Its my first attempt.Would it help to go in with a noose around my neck and an obvious packet of razorblades.My payments cease at age 59.I am in a deep dark black hole.

    Keith,

    From reading legal proceedings and IRD documents I can tell you that you can be sick through mental illness and leave you job which means your child support payments will change to suit your income.

    The law states that you as a parent must fulfill your duty as a parent to the best of your ability and that even when you are not the day-to-day caregiver you must act as if you were. That is not the actual law but a close interpretation.

    What it is saying is that you are meant to be a provider as if you were still living and providing everything. Being sick, mentally or physically is out of your control and if it were to happen when you had the children it would still be out of your control so they will change child support to suit. But you need to have doctor’s certificates and if possible councellors too.

    You need to talk to the experts on this subject, James or Mark from Parents for Children.

    Well I have just got off the phone with IRD and it has yet again enforced the complete inability of the department to the point they are a living joke.
    I rang with a very simple question, why have I received yesterday a new child support calculation. Now I know all about the July true up Blar Blar Blar (As I have been in this roundabout for 14 years) and got a new calculation about a month ago (which of course they deny) which tells me the new amount that has to be paid by my ex, which she has paid due to the extra amount that I received into my account the other day (which they also have no record of). Now do you think IRD can find any record of the letter the sent me in August for the true up.. The answer is NO. They deny it’s total existence even though I have it in front of me while I was on the phone and offered to fax it to them. But of course they did not want me to do that… Why I have no idea.
    Why can’t this department actually employ intelligent people, I even had to tell this one how to find my information on there system, which concerns me in to ways. One why do I know there system (because I sure don’t want too) and secondly why don’t they know there system (because that dam well should do)
    Well my rant for the day, have a good one all.

    in fact after the closing salutation there is nothing…

    Only a “Our Reference Number:…” is on the subject line at the top left.

    thanks julie for the helpful information.I am not mad ;just sad ;which can be quite incapacitating;but I am still capable of working.It is the ;no visible light at the end of the tunnel that gets me down.You seeem quite knowledgable.Are you per chance occupied in the mental health field;if you don’t mind answering publicly?I have trained there and now am a client instead.

    Hi Keith,

    I am not trained as such in the mental health field. Have friends who are but I am very knowledgable from life experience and through others in similar situations.

    I can understand not being able to see the light at the end of the tunnel. I used to find it hard swallowing the positive words like, “Once you get through you’ll grow as a person” etc, etc.

    And funny enough, after getting to the end of the tunnel I now tell people the same thing but with different words because it has happened to me.

    The solution is that time continually moves forward and even when we are so depressed we can’t even seem to do the little things in life, time ticks on.

    Then just one day (after what feels like forever) you feel a little stronger and the next a little more stronger and then you get to a place within yourself where you are grateful to do the little things. Your attitude starts to change because you become appreciative of just simply being capable and the huge weight starts to lift and you find yourself smiling at others, finding comfort in a conversation , even with strangers and then before you know it your life is bringing a whole new story, and with it new happiness.

    It is always sad as you will know that people kill themselves because they just can’t cope with the helplessness, the negative feelings and don’t think it is possible for things to change. But everything and everyone is continuously changing.

    I can now understand why you are making good decisions for yourself. I guess it must feel funny and challenging to take your own advice.

    Are you a Psychologist or aid or do you work in the field of addiction? That is where most of my experience comes from.

    The name in itself, has to go!!!!!

    The name “child support” is a government order; as if it is implying that you do not care about your child and the government has measures to “make you care or be responsible”

    DID YOU KNOW ???

    A. Why do g.s.t returns and other tax returns not require a 45 cent stamp on the outside envelope?

    B. Why do child support payments do require a 45 cent stamp on the outside envelope ?

    C. answer: Jenny Shipley (National) amended the law to make B. applicable back in mid 90’s..

    Child Support imply’s that you are removed from the family environment altogether, in a somewhat clinical nature.

    HOWABOUT A FEW IDEAS TO HUMANISE THIS VICIOUS 2ND CLASS CITIZEN DEPARTMENT KNOWN AS “CHILD SUPPORT” (tentacle of IRD)
    THAT MANY FATHERS HAVE TO BE STIGMATISED TO; GIVE US BACK OUR DIGNITY, THE TERM CHILD SUPPORT IS DISGRACEFUL AND HAS TO GO.

    (remember, WINZ formerly had a makeover from the name “Social welfare dept.”)

    WHAT COULD THE CHOICES BE FOR AN ALTERNATIVE NAME TO CHILD SUPPORT, THAT BRINGS WITH IT, JUST A LITTLE DIGNITY THAT IS SEVERELY LACKING.

    My choice:
    The I.R.D. Letter head should read:
    “non-custodial parent payments” (OR THE LIKE)

    (it let’s the government and my child know the connection, i have to him, i.e. i am one of his parents, not just someone of no concern giving a donation)
    people who pay child support are social lepers, we need to be recognised as parents on an equal footing to the other parent, whereby the family court
    are also bound by the IRD to protect the rights of both parents)

    CHANGE THE NAME BEFORE YOU CHANGE THE INFRASTRUCTURE, THE THE NAME CAN REFLECT THE GOOD INTENDED.
    IT WILL NOT DO THIS WHILE DUNNE CAN MAKE A MOCKERY OF FATHERS BY CHASING THEM FOR CHILD SUPPORT,
    CHILD SUPPORT IS DEROGATORY , JUST AS THE WORD NIGGER OR COON IS TO A COLOURED PERSON.

    RESTORE THE RIGHTS OF THE FATHER NOW.

    The I.R.D. Letter head should read:
    “non-custodial parent payments” (OR THE LIKE)

    (respect is long over-due) OUTSIDE YOUR HOUSE NEXT DUNNE, YOU LEECH.

    I’m happy to be proven wrong, but I think you may have the wrong end of the stick.

    When I write about tax, GST or CS, I generally address my correspondence to:

    Commissioner of Inland Revenue,
    Department of Inland Revenue,
    Private Bag,
    WELLINGTON.

    No stamp is required for correspondence with any member of parliament or any government department.

    A much bigger issue is whether you want a record of the correspondence being received by the department.

    I generally take anything to do with the Department of IR (especially CS stuff) to one of their offices and ask for a receipt at the front counter. The reception person will photocopy the front page, date stamp it with the official Department of Inland Revenue stamp and give you the date-stamped copy.

    In Auckland, this generally means a trip to Takapuna, but the receipt has proven invaluable on a number of occassions.
