Pussy Pass for Emily Toner
Well folks, who can guess what happened in the case of Emily Toner, the crown prosecutor who nipped out from Court to visit the supermarket where she deliberately concealed and stole $199 worth of groceries, and on this occasion was caught? Yep, you guessed it, DISCHARGE WITHOUT CONVICTION!
It’s reassuring to know that our legal profession can now retain the valued membership of a thief and that she will be able to continue prosecuting men, the truly bad criminals, for such dastardly crimes as waving at their children passing by in a car.
Ms Toner gave the excuse of an eating addiction that made her do it and the Court appears to have seen that as sufficient excuse. So maybe we can now expect gamblers who steal to get more money to put into pokie machines to have sufficient excuse too and to be discharged without conviction for their thievery. Well, yes perhaps, but you can be sure the Court’s mercy will only be extended to female gamblers, especially if they are also lawyers.
Similarly, most other human conditions that are accepted by Courts as mitigating factors when they affect women are seldom recognized when it comes to men’s behaviour. So when a father reacts with aggression or a minor breach of a protection order, his deep grief at having his relationship and contact with his children wrecked through false allegations is generally dismissed as a mitigating factor. The recent NZ reduction in the legal significance of provocation was based on the attitude that men should not be rewarded for any loss of self-control.
Isn’t it good to know that our Courts can still find ways to excuse women for nearly anything?
I read this same story in the Herald with a little amazement.
There was a reason the legal profession suspended people of dubious character from their ranks – something along the lines of their actions bringing disrepute upon all their number.
Now we are informed by the presiding judge that for a crown prosecutor to lose her job for thieving would be a penalty out of all proportion to her crime – meaning, of course, that the judge believes thieving to not be all that serious a reflection on her profession.
I must say I am coming to the same conclusion.

So basically the New Zealand situation is that any decent man can be convicted of a ‘crime’ based on nothing more than malicious accusation from some woman, yet female judges can go out thieving from decent hardworking shopkeepers with impunity.
What a cultural shithole New Zealand has become!

I find it astonishing that her “disorder prevented her from thinking straight”, yet she was in the midst of a Court Case where she was the Crown Prosecutor ! So this remarkable “disorder” allows her to do her job prosecuting thieves etc, but it somehow masks her own stealing ? wtf ?

The Court of Appeal today reduced a Palmerston North woman’s sentence after she was convicted of strangling a 62-year-old man.
The woman, who suffers from bipolar affective disorder, assaulted and strangled the man she believed had raped her when she was 15 and who she thought had also later sexually abused her teenaged son.
The man, who cannot be named, suffered a fractured jaw and nerve damage to his left eye in last year’s attack.
He required plastic surgery to repair facial lacerations and after treatment in Palmerston North Hospital’s intensive care unit, was transferred to Hutt Hospital where he underwent a number of operations.
The woman, who cannot be named, will serve only three years and eight months of the four years and seven months she was sentenced to. The order was made today after the appeal court found that the sentencing judge did not take into account the woman’s mental health.
The order was handed down to reduce her original sentence by 11 months, but to keep the initial ruling of her being remanded to a hospital for the duration of her sentence.

A 29-year-old Christchurch woman charged with killing her newborn baby has been sentenced to two years intensive supervision.
The woman, who has name suppression, has been residing at Hillmorton Hospital.
At a previous appearance on March 2nd the High Court heard how the woman concealed her pregnancy and gave birth in her bedroom while her eight-year-old daughter and parents were in the house.
She then smothered the newborn baby girl and hid the body in a wardrobe where it was found by her mother 45 days later.

A Rotorua mother has pleaded guilty to the 2011 manslaughter of her two month old son.
In the High Court today, Ngaire Tukiwaho admitted to failing to make all reasonable efforts to save the life of her two month old son, who suffocated while sleeping in a car with her.
The day before her son died Tukiwaho had been drinking heavily first at her sisters place and then at home, later in the night she had a heated argument with her partner and was struck in the face.
Scared for her safety she decided to sleep in a car near her sisters house.
She slept across backseat with her baby resting on her right shoulder, but during the night he slipped and suffocated behind her arm.
Tukiwaho has been remanded in custody and will be sentenced at the end of May.
i notice the male partner is mentioned and is being blamed for her being scared and making the decision to sleep in a car which led to her kid being suffocated

Actually Daniel (reply 34), Ms Toner has not worked for Meredith Connell for a long time, yet today we hear she is given another pussy pass, this time by the Lawyers’ Disciplinary Tribunal. After lying to the Tribunal about drug use, she then admitted that her shoplifting had followed a four day P binge and that she had been in rehab for drug addiction. This means that in her previous criminal hearing that also gave her a pussy pass she committed perjury because she had then blamed the shoplifting on an eating addiction with no mention of drug use. But no worries, it’s relatively ok for a lawyer, as long as she is female, to lie to Courts and professional ethics committees; instead of being struck off she was given a 3-year suspension.
Yet male lawyers are struck off for small mistakes or for even showing a bit of rudeness to the disciplinary body.
